Welcome to Clan Heritage and the Mother Lode Scots Society. These Terms of Service ("Terms") govern your access to and use of our mobile application "Clan Heritage" (the "App"), our website, and related services (collectively, the "Services") operated by Mother Lode Scots Society ("we," "us," or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of these Terms, then you may not access or use our Services.

2. Description of Services

Our Services provide information and resources about Scottish heritage, culture, and traditions. We offer:

• Access to event listings and registration
• Membership management and benefits

3. User Accounts and Registration

3.1 Account Creation

• Member: Full access with annual membership fee ($50/year) including priority event registration, newsletter subscription, and member benefits
• Officer: By invitation only, with administrative privileges

6. Payments and Refunds

6.1 Membership Fees

Membership fees are charged annually. By purchasing a membership, you agree to pay the applicable fees. All fees are non-refundable except as required by law or as explicitly stated in our refund policy.

6.2 Event Registration

Event registration fees vary by event. Early bird pricing may be available for certain events. Refund policies for events will be stated at the time of registration.

6.3 Payment Processing

Payments are processed through secure third-party payment processors. We do not store your complete payment card information on our servers.

7. Event Cancellations and Changes

We reserve the right to cancel, reschedule, or modify events at any time. In case of cancellation, we will provide a full refund of registration fees. We are not responsible for any other expenses you may incur related to the event.

8. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, secure, or error-free, or that defects will be corrected. We do not guarantee the accuracy, completeness, or usefulness of any information on the Services.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOTHER LODE SCOTS SOCIETY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICES.

Our total liability for any claims arising from or related to the Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Mother Lode Scots Society and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit, post, or transmit through the Services

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in the App. Upon termination, your right to use the Services will immediately cease.

11.2 Termination by Us

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

11.3 Effect of Termination

Upon termination, all provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

12. Third-Party Links and Services

Our Services may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by or in connection with the use of any such third-party content, goods, or services.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the state and federal courts located in California.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Services.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Services and supersede any prior agreements.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If we waive any of these terms in an individual case, that waiver will not affect any other term.
